1. Agreement to Terms

By accessing or using We Do Stuff ("the Service"), operated by Fifth Current (fifthcurrent.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

We Do Stuff is a productivity platform that provides focus sessions, task management, co-working features, and AI-assisted productivity tools. The Service includes both free and paid subscription tiers.

Focus App

A productivity and body-doubling application with the following features:

  • Focus sessions with virtual co-working
  • AI assistant (Ori) for task breakdowns and productivity support
  • Gamification (points, streaks, achievements)
  • Task and habit management
  • Subscription tiers: Free (3 sessions/day), Supporter, and Pro

Stuff App

An event planning and coordination application with the following features:

  • Event creation and scheduling
  • Date voting and coordination
  • SMS and email invitations to participants
  • Saved locations and connection management

3. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

For EU/EEA users: If you are under 16 (or under the age of digital consent in your country), you must have your parent or guardian's consent to use the Service.

4. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials.
  • You must notify us immediately of any unauthorized use of your account.
  • You are responsible for all activity that occurs under your account.

5. Subscriptions and Payments

5.1 Free Tier

Basic access to the Service is available at no cost with limited features. Free users receive 3 focus sessions per day.

5.2 Paid Subscriptions

Paid subscriptions (Supporter, Pro, and Founding Member tiers) provide additional features. Current pricing is available at /focus/pricing.

5.3 Automatic Renewal

AUTOMATIC RENEWAL NOTICE (California Business & Professions Code 17602)

Your subscription will automatically renew at the end of each billing period (monthly or annual, depending on your plan). You will be charged the then-current subscription price using the payment method on file. This will continue until you cancel.

  • Monthly subscriptions renew each month on the anniversary of your subscription start date.
  • Annual subscriptions renew each year on the anniversary of your subscription start date.
  • You will receive an email reminder before each renewal.
  • We reserve the right to change subscription pricing with at least 30 days' notice.

5.4 Cancellation

HOW TO CANCEL

You may cancel your subscription at any time through your Profile Settings → Manage Subscription, or by using the Stripe Customer Portal. Because you signed up online, you can cancel online—no phone calls or emails required.

  • Cancellation takes effect at the end of your current billing period.
  • You will retain access to paid features until your billing period ends.
  • No refunds are provided for partial billing periods, except as required by law.

5.5 EU/UK Consumer Rights

14-DAY WITHDRAWAL RIGHT

If you are a consumer in the European Union or United Kingdom, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason.

To exercise your right of withdrawal: Contact us at support@wedostuff.app with a clear statement of your decision to withdraw. You may use the subject line "Withdrawal Request" and include your account email and subscription date.

Waiver of withdrawal right: If you begin using paid features during the 14-day period, you acknowledge that you may lose your right to withdraw once the digital content has been fully provided.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, abuse, or harm other users
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service
  • Upload malicious code or content
  • Use automated systems to access the Service without permission
  • Impersonate another person or entity
  • Use the Service to send spam or unsolicited communications

7. User Content

You retain ownership of content you create using the Service (tasks, messages, etc.). By using the Service, you grant us a license to store, display, and process your content as necessary to provide the Service.

You are solely responsible for your content and must ensure it does not violate any laws or third-party rights.

8. Focus App: AI Features

The Focus app includes AI-powered features (Ori assistant, task breakdowns, smart suggestions). These features use third-party AI services (Anthropic).

IMPORTANT DISCLAIMER

  • AI responses are provided for informational and productivity purposes only.
  • AI features do not provide professional, medical, legal, or financial advice.
  • We do not guarantee the accuracy, completeness, or reliability of AI-generated content.
  • You should not rely solely on AI suggestions for important decisions.

Fair Use: AI features are subject to reasonable usage limits based on your subscription tier. Excessive automated or abusive use may result in temporary restrictions.

Opt-Out: You can disable AI features entirely in your profile settings. When disabled, no data is sent to AI providers.

9. Stuff App: Event Invitations

The Stuff app allows you to send event invitations via SMS and email to participants.

YOUR RESPONSIBILITIES

  • You must have permission to invite the phone numbers or email addresses you enter.
  • Do not use the invitation system to send spam or unsolicited messages.
  • You are responsible for the accuracy of contact information you provide.
  • Invitations are sent on your behalf—recipients will see your name as the sender.

Usage Limits: SMS invitations may be subject to reasonable limits to prevent abuse. Standard messaging rates may apply to recipients.

10. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Fifth Current and is protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our discretion, with or without notice.

You may delete your account at any time through your profile settings. Upon deletion, your data will be removed in accordance with our Privacy Policy.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FIFTH CURRENT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

For EU/UK users: Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

14. Dispute Resolution

14.1 For United States Users

Any dispute arising from these terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration will be conducted in San Francisco, California, or at another mutually agreed location.

Class Action Waiver: You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Small Claims Exception: Either party may bring claims in small claims court if the claims qualify.

14.2 For EU/UK Users

If you are a consumer in the European Union or United Kingdom, you may bring proceedings in the courts of your country of residence. Nothing in these terms affects your statutory consumer rights.

EU Online Dispute Resolution: The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

15. Governing Law

For users outside the EU/UK, these terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

For EU/UK users, these terms are governed by the laws of your country of residence, and you benefit from any mandatory consumer protection provisions.

16. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting a notice on the Service, sending you an email, or displaying a prominent notice when you next use the Service. Continued use of the Service after changes constitutes acceptance of the new terms.

17. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
